On Thursday, the National Highway Traffic Safety Administration launched an investigation into how Tesla certfiied its new Cybercab for commercial use. The probe examines whether the company correctly determined that certain federal safety requirements do not apply to a vehicle lacking pedals and steering wheels.
The Austin rollout of pedal-less Cybercabs
Tesla has officially begun operating a small fleet of its new Cybercab vehicles commercially in Austin, Texas. However, the National Highway Traffic Safety Administration (NHTSA) is now scrutinizing the technical data Tesla used to justify this deployment. The federal probe focuses on how the company decided that certain Federal Motor Vehicle Safety Standards (FMVSS) are inapplicable to a vehicle that lacks traditional controls like a brake pedal and rearview mirrors.
According to the report,Tesla notified the agency that it had already certified a small number of these vehicles as compliant with all applicable federal standards. This move has placed the regulator in a position of having to verify if Tesla's self-certification process meets the legal requirements for autonomous transit.
The Zoox precedent and the 2,500-unit allowance
This regulatory friction is not entirely unprecedented in the autonomous vehicle sector. Amazon's Zoox, a robotaxi developer that also operates without traditional driving controls, faced similar hurdles regarding vehicle design. As the report notes, Zoox eventually secured an update to safety standards in 2025, which permitted the company to deploy up to 2,500 robotaxis annually for a two-year period.
NHTSA Administrator Jonathan Morrison stated in a press release that the agency aims to balance innovation with safety oversight to maintain U.S. leadership in autonomous vehicle technology. the investigation will likely determine if Tesla can achieve a similar regulatory accommodation or if the absence of physical pedals will remain a hard barrier to widespread adoption.
A 15-minute presentation and a missing Elon Musk
The announcement of the NHTSA probe coincided with a lackluster unveiling event for the Cybercab, which was described by observers as "rocky." Footage posted by the YouTube channel Out of Spec BITS showed an event where Tesla engineers delivered a presentation lasting less than 15 minutes. Notably, CEO Elon Musk was completely absent from the proceedings.
Despite the brevity of the event, Tesla used the platform to announce that its broader robotaxi fleet has now surpassed 1 million miles of unsupervised driving. This milestone is intended to bolster confidence in the technology even as the company faces immediate legal scrutiny over the Cybercab's physical configuration.
The technical gap in Tesla's FMVSS claims
Several critical questions remain regarding the legality of Tesla's hardware-light approach. First, the agency must determine the exact technical justification Tesla used to argue that rearview mirrors and brake pedals are unnecessary for the Cybercab.. Second, while Elon Musk has suggested that individuals could eventually buy a Cybercab and add it to the Tesla network,the regulatory framework for such a consumer-to-fleet model remains unverified.
